Attorney Profile—David A. Sprecace, J.D., LL.M.


Since earning a Master of Laws degree (LL.M.) in Taxation in 1993, Mr. Sprecace has defended individual and corporate taxpayers in disputes with the I.R.S., Colorado Department of Revenue, Colorado Department of Labor and Employment, and U.S. Department of Labor, both administratively and in state and federal courts.  Mr. Sprecace has successfully represented taxpayers before the I.R.S., the Colorado Department of Revenue, and the Colorado Department of Labor and Employment in cases involving:

• employment tax;
• the Trust Fund Recovery Penalty;
• liens and levies;
• business and individual tax return audits;
• federal and state offers in compromise;
• innocent spouse provisions;
• residence and Colorado income tax issues;
• Colorado sales and use tax;
• the Colorado special mobile machinery tax; and
• Colorado unemployment insurance and worker compensation insurance tax.

Mr. Sprecace’s business litigation experience includes representation of plaintiffs and defendants in federal and state trial courts and courts of appeal in matters concerning:

• contract disputes;
• tort disputes;
• construction disputes;
• mechanics’ liens;
• civil theft;
• fraud and misrepresentation;
• piercing the corporate veil;
• the telephone consumer protection act;
• securities and construction arbitration;
• bankruptcy; and
• the federal Fair Labor Standards Act.

Mr. Sprecace received his B.A. in Political Science from the University of Arizona. He was active in campus activities, and played “A-side” rugby on the Wildcat squad for 4 years. He graduated from Creighton University School of Law in 1989, and was a member of the Creighton Law Review from 1987 through 1989.

Mr. Sprecace is a member of the Colorado, Florida, and Nebraska bar associations, and is licensed to practice before the I.R.S., the U.S. Tax Court, the 9th and 10th Circuit Courts of Appeals, and several other federal district courts. He presently serves on the City of Englewood Board of Adjustment and Appeals, and on the City of Englewood bench as an Associate Municipal Judge. He has served in the following capacities in the past:
1999-2001, Secretary/Treasurer, SAFE Colorado;
2001-2009, member, Colorado Board of Health;
2002, President, Greater Denver Tax Counsel Association;
2002, Director, Metro Wastewater Reclamation District;
2001-2003, Director, Community College of Denver Foundation;

2003-2007, 2009, President, Lincoln Club of Colorado.
